Terms and Conditions

In using Crowdmass.com.au you are deemed to have read and agreed to the following terms and conditions:

A reference to “we” or “us” is a reference to Crowdmass Pty Ltd as a business entity, ACN: 147 544 705

A reference to “you” or “your” is a person who is in possession of the card at the relevant time for the purpose of these Terms of use, or who authorises another person to do something with or to the card on their behalf.

A reference to “the business” is the merchant who has offered goods and services where the vouchers are redeemable.

“Voucher” means the printable certificate of that name that is issued to the purchaser’s email address.

Acceptance

  1. By using the website, you accept and agree to be bound by these Terms and Conditions and the terms of our privacy policy.
  2. Crowdmass Pty Ltd reserves the right to make any changes to our Terms and Conditions or our Privacy Policy as necessary or as required, without prior notification. Your continued use of the site constitutes the acceptance of these changes.

  1. Accounts

    Creation of accounts

    Purchase of the ‘Voucher’ will require you to register an account.

    The Service is made available to you for your personal use only. You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur there under

    Crowdmass Pty Ltd may terminate the accounts of any users whose conduct which Crowdmass Pty Ltd, in its sole discretion, consider to be unacceptable.

  2. Email subscription

    At any time you are able to provide Crowdmass with authorisation to send administrative and promotional emails. You may unsubscribe to our promotional emails anytime by following the links contained at the bottom of our email correspondence.

  3. Limitation of liability

    Crowdmass Pty Ltd takes no responsibility for the services or products that is offered through the voucher.

    Crowdmass Pty Ltd makes no warranty to the quality, safety, usability or other aspect of the product or service for which the voucher is redeemed.

    Any complaints about goods or services purchased with a voucher must be resolved directly with the store concerned.

  4. Disclaimer of liability

    Crowdmass Pty Ltd is excluded from all liability for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including without limitation, damages for loss of life, data or profits, arising out of or in any way connected with the use or performance of www.crowdmass.com.au, the delay or inability to use www.crowdmass.com.au, the provision of or failure to provide goods or services, or any information, software, products or services obtained through www.crowdmass.com.au.

    You agree to hold harmless and indemnify Crowdmass Pty Ltd, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.

  5. Copyright and Trademark

    Crowdmass Pty Ltd and third parties own copyright in the material available at this website. The materials on this site, including all information, graphics and text, must not be reproduced, copied, edited, published, transmitted or up-loaded in any way without the written consent of the owners of that copyright.

    Trademarks used on this Web site to describe businesses and their products are trademarks of those firms or the registered proprietor of the trademark and may not be used in any way without the written consent of the owners of that trademark.

  6. Accuracy of Content

    Crowdmass Pty Ltd does its most utmost to ensure the accuracy of the content that we provide. We cannot ensure that all information such as comments, messages, texts, images, photos and other materials posted on or transmitted through website are accurate and they are the sole responsibility of the person from whom the content originated.

  7. Refunds

    Refunds will be dealt on a case to case basis and will only be provided in the most exceptional circumstances. The decision will be at the sole discretion of Crowdmass Pty Ltd.

Terms of sale

  1. It is a condition of the sale that you agree and adhere to the general terms and conditions as prescribed below as well as the conditions prescribed on individual voucher.
  2. You understand and agree that once an order for a voucher is placed, the cancellation of your order is forbidden.
  3. All payments are to be received in full, before voucher is delivered. All vouchers are delivered at the conclusion of a deal.
  4. Delivery of all vouchers is by an email at the end of the deal with a hyperlink with instructions on how to download your voucher.
  5. If payment cannot be debited for any reasons including account suspension, cancellation or fraudulent reasons, we have the right to cancel your order and we will not deliver your voucher.
  6. The voucher will not be available for use after the voucher’s expiry date.
  7. Your voucher must be used in one transaction and may not be used incrementally. Any unused credit is forfeited.
  8. If you redeem the voucher for a value less than what is stated on the voucher, you will not be able to obtain credit, cash or new voucher equal to the difference between the face value and the amount you redeemed.
  9. Lost or stolen vouchers are not the responsibility of us or the business. It is the purchaser’s responsibility to ensure that the voucher is kept safe.
  10. Crowdmass Pty Ltd reserves the right to reject your order for any reason including, but not limited to, an error in the pricing of the deal, the inability for us to debit your credit card, or the insufficient number of buyers of a deal. If the event arises that we cancel you order, your PayPal account or credit card will not be charged, or if you have already been charged then a full refund will be provided.
  11. Using vouchers to purchase alcoholic beverages is at the discretion of the vendor. The vendor agrees to comply with all state and federal laws pertaining to the serving of alcohol.
  12. For vouchers at places where food and beverages are served, the voucher is valid for dine in only unless otherwise stated.
  13. Vouchers are void to the extent prohibited by law.
  14. The voucher is not to be used in conjunction with any discounts or other promotions.
  15. The prices of the vouchers are shown are in Australian dollars.
